The former personal attorney for Donald Trump has stepped down as the chief federal prosecutor in the state. This comes after a judicial decision that challenged her eligibility to hold the office.

Attorney General's Statement

The head of the Justice Department, Pam Bondi, accepted her stepping down on Monday. In a statement that the judicial decision made it "untenable" for Habba to lead the department effectively.

"Do not interpret compliance for surrender," Habba stated. "This battle will now extend throughout America."

Habba's exit was triggered by a US appeals court found that she had been serving in violation of the law as US attorney. This decision is expected to impact numerous legal proceedings in New Jersey.

The court declared that a interim role that skirted Senate approval violated the Federal Vacancies Reform Act.

Bondi said that she will stay on at the justice department as a top consultant. Habba plans to seek further review of the disqualification, aiming for a different outcome.

On a social media platform, she wrote that the court "must not override the President's choice of attorneys responsible for carrying out the primary duty of the administration of enforcing the law."

Bondi praised Habba's record and noted that during her run, the city of Newark saw a significant drop in offenses. It was also reported that the southern city of Camden recorded its initial homicide-free summer since 1974 free from homicides.

The 41-year-old attorney, first joined the former president's legal defense in 2021. Subsequently, she represented her client in his business records case in New York last year, which resulted in his conviction on multiple felony counts of financial record manipulation.
